In short
Last updated October 15, 2026. Before launch. Free and Sober is not in the app stores yet. These terms apply from the launch of the Free and Sober app. They describe the app as it will work at launch. These terms are the agreement between you and us when you use Free and Sober. The short version: Free and Sober is a sobriety app for adults in the United States. It is a wellness app, not medical care, and the mentor is an AI, not a person. If you are in danger, call 911, or call or text 988. You pay for plans through the App Store or Google Play, monthly, and you cancel there. What you create is yours; we use it only to run the app for you. Every Time Capsule stays sealed until its day. At launch, your Time Capsules, corner capsules and journal are also end-to-end encrypted with a key made on your phone, so we can't open them. Your key is yours to keep: we can't recover or reset it, and if your key and your recovery key are both lost, nobody can open them. Please read the whole page, because it is a binding agreement.
About these terms
These terms are between you and Free and Sober Inc., a Delaware corporation. In these terms, "Free and Sober," "we," "us" and "our" mean Free and Sober Inc. "Free and Sober" is also the name of our app and service. "You" means the person using the app or website.
These terms cover the Free and Sober app, the freeandsober.com website, and everything we offer through them. When you create an account, the app shows you links to these terms and to our Privacy Policy and asks you to tap "I agree." By tapping it, you agree to these terms and acknowledge our Privacy Policy. If you do not agree, please do not use Free and Sober.
Who can use Free and Sober
- You must be 18 or older.
- You must be in the United States. Free and Sober is available only in the US, and in English.
- You must live in one of the 50 states or the District of Columbia where Free and Sober is available. At launch that is every state but Utah. The app asks your state when you sign up, and if it isn't available where you live yet, you can join a waitlist.
- You must be able to agree to these terms.
When you sign up, we check that you are 18 or older, using the age range your app store provides where it provides one, or, where it does not, your own answer.
If we learn that someone under 18 is using the app, we first make sure they have crisis resources if they need them. Then we restrict the account at once, and delete it and the information we collected within 30 days, which gives an adult identified as under 18 by mistake time to confirm their age. If they are under 13, we delete it at once.
Free and Sober is not medical care
Free and Sober is a wellness app, a sobriety app for adults. It does not diagnose, treat, cure or prevent any disease or condition, and it is not a substitute for treatment.
- It does not replace a doctor, a counselor, a treatment program, a meeting, or a sponsor.
- Check with a doctor before you make any medical decision, including stopping or changing any medicine.
- Stopping some substances suddenly can be dangerous. If you drink heavily every day, or take benzodiazepines, other sedatives or opioids every day, talk to a doctor before you stop. Withdrawal can cause seizures and can be life-threatening. The SAMHSA National Helpline, 1-800-662-4357, can help you find detox, free, any hour. This is a fixed safety warning in the app, not advice from the mentor.
- Nothing in the app, including the mentor, the 30-day program, and anything we publish, is medical advice.
- If you ask a mentor for medical advice, it declines and says it can't help with that. It's an AI, not a doctor. We count how often this happens, without keeping what you said.
The mentor is an AI
The mentor is software. It is not a person.
- It is not a therapist, counselor, clinician, doctor, or sponsor, and it never presents itself as one.
- It's a place to talk things through, like journaling out loud. It listens, reflects back what you say, and asks questions that help you think. It doesn't give advice, coping techniques or anything about medication, and it doesn't judge how serious your situation is.
- Every mentor screen says: "I'm an AI, not a therapist or counselor, and this isn't medical advice or treatment. It's not a substitute for clinical care."
- It can be wrong. Do not rely on it for medical, legal, or financial decisions.
- It tells you it is an AI before you first use it, at the start of every session, when you come back after seven days away, every hour of continued use, and whenever you ask.
Read The mentor and your safety to learn how the mentor works, and our crisis protocol for how it handles a crisis.
If you are in crisis
Free and Sober is not an emergency service.
- If you or someone else is in immediate danger, call 911.
- If you are thinking about suicide or are in emotional distress, call or text 988, the Suicide and Crisis Lifeline, any hour. You can also chat at 988lifeline.org.
- For help finding treatment or detox, call the SAMHSA National Helpline, 1-800-662-4357, free, any hour.
- If you are outside the US, contact your local emergency number, or find a free line in your country at findahelpline.com.
The app shows 988 and 911 as buttons, but it cannot call anyone for you, send help, or know where you are. It will never say it has called someone when it has not. No one at Free and Sober reads your conversations or watches for emergencies. Phones, networks and apps can fail, so if you are in danger, dial directly. Our published crisis protocol explains what the app does when it sees signs of danger.
Your account
- You sign in with your email address and a six-digit code we send you. There is no password.
- Keep your email account secure. Anyone who can read your email can sign in to your Free and Sober account.
- Signing in doesn't open your vault. At launch, your vault opens only with your key (see "Your vault and your key" below). Someone who signs in as you can't open it without your key, but could change or delete your account, including your Time Capsules.
- One account is for one person. Do not share it, and do not use someone else's.
- Give us true information where the app asks for it, such as your email address and your age.
- Your account is always yours, even if an organization pays for your plan.
- Tell us right away at support@freeandsober.com if you think someone else has used your account.
You can turn on your phone's lock for the app, where the app offers it. You are responsible for who can pick up and open your phone.
Subscriptions and the free trial
Plans
Free and Sober is sold as a monthly subscription through Apple's App Store or Google Play. If we offer plans on our website (we don't yet), you can buy the same plans there, through Stripe. There are no yearly plans. The plans, prices and what each includes are on our Billing and subscriptions page. Prices are in US dollars.
How payment works
- Payment is charged to your Apple or Google account when you confirm the purchase, or, for the Essentials trial, when the trial ends.
- Apple or Google handles the payment, your receipts, and your billing information under its own terms. We never see your card number.
- If you buy a plan on our website, payment is charged to your card through Stripe when you confirm, or, for the Essentials trial, when the trial ends. Stripe handles the payment, your receipts, and your billing information under its own terms, and we never see your card number. The trial is offered there only if you have never had a Free and Sober plan. If you delete your account, a plan bought on our website won't renew, and it ends when the account is deleted. We charge a plan bought there a higher price only if you agree to it.
- Prices are before tax. Sales tax is added at checkout where it applies, as your store calculates it.
The free trial
- Essentials comes with a 3-day free trial. No other plan has a trial.
- After 3 days, you'll be charged $12.99 a month plus tax, every month, until you cancel. On Apple, cancel at least 24 hours before the trial ends to avoid the charge.
- If you allow notifications, the app reminds you at least 48 hours before the trial ends, with the price, the day of the first charge and how to cancel. The Home screen shows the same reminder when you open the app in those 48 hours.
- If you buy a different plan during the trial, the rest of the trial ends and the new plan starts. That is how Apple handles it; on Google Play, the store shows you the exact timing before you confirm.
Automatic renewal
- Your subscription renews automatically at the end of each monthly period, at the price then in effect, until you cancel.
- On Apple, turn off renewal at least 24 hours before the end of the current period, or you will be charged for the next one. Apple charges for renewal within the 24 hours before the period ends.
- Price changes. We'll tell you by email at least 21 days before any price change takes effect, and your store tells you too, as its rules require. We charge you a higher price only if you agree to it through your store. You can cancel before the new price starts.
- Yearly reminder. Once a year, we'll remind you by email that your plan renews every month, what it costs, and how to cancel.
- Monthly note. Each time your plan renews, we send you a short note with the amount charged and how to cancel.
Canceling
- Cancel in your App Store or Google Play subscription settings. The app's Plan screen links there. A plan bought on our website is cancelled on our website: You, then Plan, then Manage or cancel. Step-by-step instructions are on our Billing and subscriptions page.
- If you can't find the setting, email support@freeandsober.com with "Cancel" in the subject line, and we'll reply with the exact steps. If you bought on Google Play, we can also cancel it for you: ask us from the email address on your account, and we'll cancel it and confirm within two working days. We can't cancel an App Store subscription for you, because Apple holds it.
- Deleting the app, or deleting your account, does not cancel your subscription.
- After you cancel, you keep your plan until the end of the month you paid for.
- On Google Play, you can pause instead, for up to three months, under Google's rules. Your plan runs to the end of the month you paid for, then pauses. Nothing is charged and nothing in your account is deleted while it's paused, and it starts again on its own on the day you chose.
Refunds
Refunds for App Store purchases are decided by Apple under its refund policies. Ask Apple directly; we cannot issue refunds for App Store purchases ourselves. For Google Play purchases, ask Google within 48 hours of the purchase; after that, Google asks you to contact us at support@freeandsober.com. If you bought on Google Play and ask us after those 48 hours, we refund your most recent monthly charge if you ask within 7 days of that charge. We also refund any charge made in error, or made after you asked us to cancel. Otherwise, your plan runs to the end of the month you paid for. Our Billing and subscriptions page explains how to ask.
What stays open without a subscription
When a trial or subscription ends, some things always stay open to you: your day count and progress, your calendar and its reminders, your journal, every Time Capsule (which still opens on its day and can be watched and exported; at launch, that takes your key, with or without a plan), the crisis tools, any voice minutes you bought, and export and delete. The full list is on our Billing and subscriptions page.
Voice minutes
Voice minutes pay for time with the mentor by voice and with the talking avatar. Messaging the mentor is part of your plan and does not use minutes.
- How minutes are counted. A minute of voice uses 1 voice minute. A minute of video with the talking avatar uses 3.
- Packs. You can buy packs of voice minutes on any plan through the App Store or Google Play.
- Monthly minutes. Plus includes 30 voice minutes a month and Premium includes 120. Monthly minutes are used first. They reset each month and do not carry over.
- Purchased minutes never expire. They stay in your account, even if your subscription ends, so they are there when you come back.
- Trial minutes. The Essentials trial includes 10 voice minutes. They are a gift, and they end when the trial ends.
- Price changes. If our costs go up, the change applies only to new packs. A minute you already bought keeps its value.
- No surprise charges. Minutes never top up automatically. When they run low, the app asks first, and each purchase is your tap in your phone's store. You can set a monthly spending cap.
- Crisis and cravings never use voice minutes. A craving or crisis conversation never uses voice minutes, and the mentor's crisis response is never capped; other messages, a craving's included, count toward your plan's messages for the day. If your balance is zero, the conversation continues in messages, read aloud by your phone's own voice.
- Limits. Voice minutes have no cash value. You cannot sell them, transfer them to another account, or exchange them for money, except where the law requires otherwise.
Organizations and join codes
Treatment centers, sober living homes, programs and other organizations can give their members a join code.
- Consent first. Before you join, the app shows one screen listing what the organization will see and what is not shared with your program. You decide whether to agree.
- What an organization sees. Engagement counts for all its members together. It can't tell who from them. If you sign its separate privacy disclosure, its staff also see your first name and last initial beside your seat, until you withdraw. It is billed for each member, so its monthly invoice shows the exact number of members on each plan. Not shared with your program: your words, recordings, mentor conversations, notes, calendar or Your Corner, except what you say and show in a video meeting with its staff that you choose to join.
- The mentor while a program gives you your seat. While an organization's program gives you your seat, the mentor is part of your plan by message and by voice, never on video, with the voice minutes of the plan your organization chose and nothing to buy. The crisis help in the app stays on. If you leave the program or your seat ends, you can use the mentor on a plan of your own.
- Messages to all members or a group. An organization may send messages to all of its members, or to a group of at least 11 of them, if you agree to receive them in the app, as described below. These aren't about you alone, so they don't need your signature.
- Anything about you alone needs your signature, both ways. If an organization connects its own systems to Free and Sober, or offers capsules or messages from your care team, nothing about you goes to it, and nothing addressed to you alone comes from it to your app, until you sign a separate privacy disclosure in the app. It lists what the organization could send you (appointments and program dates, which you accept or decline one by one, and sealed capsules and messages from your care team, described below) and what it could see. You choose, and you can withdraw your signature at any time. It stops that day, both ways, and the organization learns only that sharing ended, not why; appointments already on your calendar stay yours to keep or delete. Your Time Capsules, corner capsules and journal are never shared, signed or not: at launch, they will be encrypted so only your key can open them, and neither the organization, its systems nor we can.
- What every member sees. An organization's name, logo and general resources page are the same for every member, and are not about you.
- Plans an organization pays for. Redeeming its code turns on the plan it picked for you, at no charge to you. There is no trial, and you never give the organization payment details. If you already pay for a plan through the App Store or Google Play, cancel it yourself in your store's subscription settings, or you will pay twice. The app reminds you when you join, but it cannot cancel a store subscription for you.
- Leaving. You can leave an organization from the You tab at any time. Sharing stops that day.
- When your organization's seat ends, the app shows you the day as soon as your organization sets it. You keep everything you built: your count and history, every Time Capsule and answer, milestones, Your Corner, your safety plan, the mentor's memory, and any voice minutes you bought. The organization's branding and resources end. Its paid plan ends too, unless it chose aftercare months, which keep your plan going for those months. After that, to keep a plan, you can choose one yourself.
- Your account stays yours. An organization cannot delete, export or keep your data when you leave.
Organizations that use Free and Sober agree to separate terms with us.
Capsules and messages from your care team
If your organization offers them and you sign its privacy disclosure, your counselor or your care team may send you sealed capsules, and messages, addressed to you alone through Free and Sober.
- They come from the people who send them, not from Free and Sober, and are not medical advice, treatment or emergency help. If you are in danger, use the crisis help in the app or call 988 or 911.
- One reply, if you want. You can send one quick reply to each: "Thank you" or "Can we talk?" to a capsule, and "Thank you", "I'm OK" or "Can we talk?" to a message. "Can we talk?" asks your organization to reach out to you; it isn't monitored around the clock, and nobody promises a time to answer.
- Messages arrive when they may. Your organization can send at most 10 messages in any 7 days, and each is checked when it is due. One that can't reach you within 14 days of its day, because you muted its sender or it waited for that limit, is deleted, and so is every one not yet delivered when you withdraw or leave, or your organization stops offering them.
- Mute, withdraw or leave any time. You can mute your counselor or your whole organization in You, then Your program. Capsules already sealed for you stay yours and open on their day, and messages already delivered stay yours, as the Privacy Policy explains, including what a mute leaves out.
- Yours to keep or delete. A capsule or a message stays until you delete it or your account. If you delete a capsule, your care team sees that you removed it, and nothing more; if you delete a message, it is gone from what they see, except a "Can we talk?" you sent about it. We may remove one, or stop an organization from sending them, if it breaks these terms.
Messages from your organization to its members
If your organization offers them and you agree to receive them in the app, it may send voice, video or written messages to all of its members, or to a group of at least 11 members.
- They come from your organization, not from Free and Sober, and are not medical advice, treatment or emergency help. Nobody watches them for replies, and there are none: you can send a heart or report one. If you are in danger, use the crisis help in the app or call 988 or 911.
- What it sees. Only group totals, with any number from 1 to 10 shown as "fewer than 11", never whether you, personally, opened one, sent a heart or reported one.
- Mute or leave any time. You can mute them in You, then Your program. While they're muted, your organization sees one fewer member in its counts but is never told it was you. Leaving the organization stops them.
- Yours to keep or delete. One you have stays until you delete it or your account, unless your organization withdraws it or we remove it, which takes it from every member's messages. We may remove a message, or stop an organization from sending them, if it breaks these terms. Report one from its screen in Messages.
Meetings with your program
If your program uses them, and you sign the version of its privacy disclosure that covers them and agree to the notice about them in the app, you can join video meetings its staff hold in the app, in a group or one-on-one.
- Your program runs them, not Free and Sober. Its staff host them, and your program, not Free and Sober, answers for what its staff say in them. They are not medical advice or emergency help from us.
- No recording. Nobody may record a meeting, by any means. Free and Sober never records or transcribes one. We can't stop someone from recording on their own device, so share only what you're comfortable sharing.
- What is said in a group stays there. Don't repeat or share what someone else says in a group meeting, or who was there.
- The host is in charge. A host lets people in from the waiting room, and may mute or remove anyone, or end the meeting.
- Not for emergencies. Nobody watches meetings for one. If you need help now, call or text 988, or call 911.
Your content
"Your content" means what you create or add in Free and Sober: your recordings, your answers, what you write and say, your reasons, your calendar, your journal, your safety plan, and the rest.
- It is yours. You keep all rights to your content.
- Our license is narrow. You give us permission to store, process, copy and transmit your content only to run Free and Sober for you, as our Privacy Policy describes. That includes sending it to our service providers, and to AI providers only after you consent. This permission ends when you delete the content or your account, except for copies the law requires us to keep and backups that are replaced over time.
- We do not use it for ads, sell it, or use it to train AI models.
- You are responsible for your content. Only record and share what you have the right to. Do not record other people without their permission.
Your vault and your key
At launch, your Time Capsules, corner capsules and journal, and the other private things our Privacy Policy lists, are end-to-end encrypted, with the limits below. In these terms, we call them your vault. What you put in your vault is encrypted on your phone before it is stored. Corner capsules and notes are encrypted for your key in the sender's web browser. Appointments an organization sends you are encrypted for your key on our server as they arrive, after our server has read them. What we store from your vault opens only with your key.
- Your key. Your key is made on your phone. We never have it in a form we can use, so we can't read what's in your vault.
- Where your key is kept. On your phone. On iPhone, also in iCloud Keychain, if you use it. On Android, also in your Google account's encrypted backup, if your phone supports it and backup is on. Apple and Google keep those copies under their own terms, and we can't promise that your phone's backup holds your key. You can also move your key from your old phone to a new one, iPhone or Android, by scanning a code your old phone shows.
- Your recovery key. The app offers to make a recovery key after your first capsule is sealed: 24 words you write down or print. With them, your vault opens on any phone, including when you move between iPhone and Android, which the phones' own backups don't do. If you make one, we keep a copy of your key locked with it, and only those 24 words open that copy. The app shows the words once, and we never keep them. Making one is your choice for most capsules, but without it, losing your phone can mean losing your vault. Before you seal a capsule that opens more than a year out, the app asks you to make one if you haven't, and on an Android phone that can't back up your key, you need one to seal it.
- Keeping them safe is up to you. You are responsible for keeping your key and your recovery key, and for keeping your recovery key private, somewhere you'll find it years from now. Anyone who has your recovery key and can sign in to your account can open your vault. We will never ask you for it. If you send it to us, we delete the message and ask you to make a new one.
- We can't recover, reset or show them. Nobody at Free and Sober can recover, reset or show your key or your recovery key, or make a new key that opens what you already have.
- If they are all lost, the loss is permanent. If every phone that holds your key, your phone's backup of it and your recovery key are lost, what's in your vault can never be opened again, by you, by us or by anyone. That includes Time Capsules that haven't reached their day. Removing the app or resetting your phone can delete the copy of your key on that phone, so make sure your key is somewhere else first, such as in your recovery key. Signing out keeps your key on that phone, so anyone who has the phone and can sign in as you could open your vault there.
- A new recovery key replaces the old one. Each recovery key opens the key it was made for. When you make a new one, the old words stop working, though a copy locked with them can stay in our backups for a time (see "Ending your account").
- Starting a new vault. If your key can't be found, you can start a new vault, so what you make next is locked with a new key. What was in the old vault stays locked, including corner capsules sent to your old key. Its capsules still reach their day, but only your old key, or the recovery key made for it, can play them. We keep the old vault for as long as your account exists, in case you find either, and it opens again if you do. You can delete what's in it instead. A capsule in it that is still sealed can be deleted once 7 days have passed since your key or recovery key last changed. Deleting one never opens it.
- Only in the app, on a phone. Your vault opens only in the Free and Sober app on an iPhone or Android phone, not in a web browser.
End-to-end encryption has limits:
- We still see some details. It locks what's inside your vault, not the details around it. We can still see your account, your email address and first name, your start date and counts, the days and times on your calendar, your IP address and our logs of what your app asks our servers for, and, for everything in your vault, that it exists, when it was saved and roughly how big it is. For each capsule, we can also see its kind, when you sealed it, the time zone, the day it opens, when it was first played, which version of your key locks it and how big its file is. Its size can show whether it is a video, a voice recording or writing, and roughly how long a recording is. Our Privacy Policy lists what stays readable. If someone breaks into our systems, or the law requires us to hand over what we hold, these details can be seen too.
- The mentor is not in your vault. The mentor has to read what you send it. What you say to the mentor, what it says back, and what your phone sends it from your vault, such as your reasons, the mentor's memory and any journal entry you let it read, is read on our servers and sent to our AI providers so the mentor can answer you, as our Privacy Policy explains. It is not end-to-end encrypted.
- Appointments an organization sends you. Our server reads each one as it arrives, to check it, before encrypting it for your key. The organization keeps its own records under its own rules.
- Corner capsules depend on our web page. They are encrypted in the sender's browser by a web page our server provides, so they are only as safe as that page. The encryption doesn't show who sent one: the sender's name comes from our records.
- Your phone. Encryption can't protect your vault on a phone that is unlocked in someone else's hands, that has harmful software on it, or that runs a changed copy of the app. What you open is readable on your phone while you use it, such as while a capsule plays. A recording you haven't sealed yet stays on your phone, and isn't locked with your key, until you seal it.
- Copies outside the app. The seal and the encryption cover what we store. They don't cover a copy kept outside Free and Sober, such as a copy of your data you save or share, a screen recording, or a copy your phone's camera app or photo backup keeps.
- It keeps things private, not safe from loss. Encryption keeps what's in your vault from being read. It doesn't stop a file from being lost, damaged, delayed or deleted. We can't open a locked file, so we can't check it or repair it.
- No security is perfect. Encryption depends on your phone, the app and our web page working as designed. We can't promise that no one will ever get into our systems, your phone, or your Apple or Google account.
- Court orders. If the law requires us to hand over what we hold, all we can give from your vault is the locked files and the details we can read. We can't unlock them, and we don't have a key that opens them.
- Family and estates. We can't open or play what's in your vault for your family or your estate, even with a court order, because we don't have your key. With proof of death, we can delete the account.
The Time Capsule
The Time Capsule is a message from you to your future self. The first one of each count is sealed for 30 days, and later ones until a day you pick. Essentials holds 1 sealed capsule at a time, and Plus and Premium hold up to 3. When one opens, you can seal another. These rules are built into the app and our database. We don't make exceptions to them, and our support team has no tool to open a capsule early.
- One first capsule per count. Make it on video or by voice, up to 90 seconds, or in writing. You can record or write it again as many times as you like before you seal it. Once it is sealed, that count's first capsule is done.
- Then more, up to your plan's limit. Once a count's first capsule is sealed, you can seal more, each opening on a day you pick, from the day after you seal it to ten years out. Sealing more needs a plan. Essentials holds 1 sealed capsule at a time, and Plus and Premium hold up to 3, counting the first. When a capsule opens, it no longer counts, and you can seal another. A capsule you take back doesn't count. A count's first capsule can always be sealed, even at your plan's limit. If your plan changes or ends, every capsule you sealed still opens on its day; only sealing another waits until you are under your plan's limit. Every rule on this list applies to each of them.
- One hour to take it back. For one hour after you seal a capsule, you can take it back. That deletes it, and you can record a new one. The hour counts from when our server recorded the seal, and taking it back needs a connection. You can't undo a take-back, and we won't restore it. A copy can stay in our backups for a time before it is erased (see "Ending your account"). At launch, that copy is locked with your key.
- Then it is sealed. After the hour, it stays sealed until its day: 30 days after the day you sealed it for a count's first capsule, or the day you picked for any other, counted in the time zone you were in when you sealed it. Changing your time zone or your start date later does not move that day.
- Nobody can open it early. Not you, and not our support team. A database rule enforces the seal, not just a screen. At launch, your capsule will also be end-to-end encrypted, so we can't open it at any time, even if you ask, and if the law requires us to hand it over, all we can give is the locked file and the details we can read, such as its dates.
- It opens on its day. It opens as long as your account exists and we still offer Free and Sober, whether or not you slipped, and whether or not you still subscribe. At launch, it plays on a phone that has your key, or once you enter your recovery key. If your key and your recovery key are both lost, the capsule still reaches its day, but nobody can play it, including us. A capsule can wait up to ten years, and phones and backups change in that time, so keep your recovery key where you'll find it.
- After it opens, you can play it and save a copy through Export your data (see "Saving a copy of your data"). A count's first capsule also takes an answer of up to 90 seconds.
- Deleting a sealed capsule. After its first hour, a sealed capsule is deleted only when your account is deleted, including when we close it, or, at launch, when you delete what's locked in an old vault after starting a new one, once 7 days have passed since your key or recovery key last changed. Deleting one never opens it.
- Deleting your account deletes every capsule, sealed or not, including ones you have not heard yet. A capsule that hasn't opened can't be saved first. Once your account is deleted, you can't undo it, and we won't restore them. Copies can stay in our backups for a time before they are erased (see "Ending your account"). At launch, those copies are locked with your key, and once your account is deleted, the app also deletes your key from the phone you deleted it on and from that phone's own backup.
Your Corner
Your Corner lets you share your progress with people you choose, by their first name and email address. It is part of Plus (up to 5 people) and Premium (up to 15 people).
- Only add people who know you and who are safe for you.
- Each person gets one invite email and must accept before they see anything. Every email has a one-click way to stop.
- You choose what each person sees, and you can remove anyone at any time.
- People in your corner are not crisis contacts. They are never alerted in a crisis.
- On Plus and Premium, people in your corner can record a sealed voice message for you, if you turn that on for them. You can delete one unopened, report it, or remove the sender. At launch, it is end-to-end encrypted, so only your key can play it (see "Your vault and your key").
If someone added you to their corner, you can stop their emails at any time with one click.
Messages from your corner
On Plus and Premium, people in your corner may send you the voice and video messages and video capsules you allow, as the Privacy Policy describes.
- They come from the people who send them, not from Free and Sober, and are not medical advice, treatment or emergency help. If you are in danger, use the crisis help in the app or call 988 or 911.
- You decide. You choose what each person may send, and you can mute, block, remove or report anyone at any time. They are not told, and they never see whether you opened a message. Replies are not part of this feature.
- Yours to keep or delete. What you receive stays until you delete it or your account, including after you move to Essentials.
- If you record one for someone, these terms apply to you too: follow "Acceptable use," send only what the person allowed, and up to five notes and messages a day. We may remove content that breaks these terms, or a sender's ability to message someone.
Acceptable use
Please use Free and Sober in the spirit it was made. You agree not to:
- Break the law, or use the app to help anyone else break it
- Harass, threaten, or harm anyone, including through Your Corner, a corner capsule or a voice or video message
- Add someone to your corner, or send them anything, if they asked not to be contacted, or if you have a no-contact or protective order with them
- Record, upload or share anything you do not have the right to, or anything that sexualizes or exploits anyone
- Pretend to be someone else, or use someone else's account
- Try to break or get around our security, the encryption, the Time Capsule seal, the daily limits, or the limits on voice minutes
- Try to get the mentor to produce harmful content, such as instructions for self-harm or for misusing drugs
- Use sexual, racist, hateful or abusive language with a mentor, or try to draw a mentor into sexual talk or role-play
- Use bots, scrapers or other automated tools to access the app, or copy, resell or reverse engineer it, except as the law allows
- Use the app for anyone under 18
If you abuse a mentor, the mentor sets a boundary first. If it keeps happening, voice and video pause, then talking with the mentor pauses, and repeated abuse can end mentor access on your account. Your count, Time Capsules, journal and the crisis buttons stay open no matter what. See The mentor and your safety.
If you see something wrong, including anything a mentor said, report it with the report option in the app or at support@freeandsober.com.
Saving a copy of your data
You can save a copy of your data at any time, with or without a plan, in the app under You, then Export your data.
- At launch, your copy is made on your phone, where your key is. It holds your data, including what's in your vault that your phone can open and every capsule that has opened, ready to play.
- Sealed capsules aren't in it. A capsule that hasn't reached its day stays sealed, even in a copy: your copy lists it with the day it opens, but not what's in it. Anything locked with a key that isn't on that phone is listed as locked, not included.
- Your copy isn't encrypted. Anyone who gets the file can read it, so keep it somewhere private. Once you save or share it, we can't protect it or delete it.
- Making it needs a connection and space on your phone, and a large copy takes time. If it doesn't finish, start it again.
Ending your account
- You can leave any time. Delete your account in the app under You, then Delete your account. Delete my account signs you out on every phone and deletes your account 30 days later; until then, nothing in it is used and nothing is sent to you, and signing in lets you keep it, just as it was. Delete everything now deletes it at once. Either way, deleting it deletes everything, except the limited records listed in our Privacy Policy, and once it is deleted you can't undo it. Copies in our backups, and in our storage provider's recovery of deleted files, are erased on a schedule, which is now 30 days and is never more than six months. At launch, what was in your vault stays locked with your key in those copies, and once your account is deleted, the app also deletes your key from the phone you deleted it on and from that phone's own backup. If you made a recovery key, you can destroy it. You can make a copy of your data first, but a capsule that hasn't opened can't be copied.
- We may suspend or close an account if it breaks these terms in a serious or repeated way, if it puts others at risk, or if the law requires it. Where the law and safety allow, we tell you why and give you a chance to download a copy of your data first. If we close your account, we delete it and what's in it, including Time Capsules that haven't opened, which can't be copied before their day. We keep only the limited records listed in our Privacy Policy and copies the law requires us to keep, and copies in our backups are erased on the schedule above. Closing your account does not cancel a store subscription, so we tell you how to cancel an App Store subscription, and we cancel a Google Play subscription ourselves, so that you are not charged again. If we close your account for a serious or repeated breach of these terms, we don't refund the current month. If we close it for any other reason, we refund the current month of a Google Play subscription, and we support your request to Apple for a refund of an App Store subscription.
- If you are under 18, we restrict the account and delete it, as described above.
The sections of these terms that by their nature should continue after your account ends will continue, including the disclaimers, limits of liability, and dispute terms.
Other services we point you to
The app points you to services we do not run, such as crisis lines, meeting listings from local fellowships and meeting systems, detox and treatment finders, and the iCloud Keychain and Google backups that can keep a copy of your key. They are independent of us, and we are not responsible for them. Meeting times and places can change, so check before you go.
AA, NA, SMART Recovery, Recovery Dharma, Celebrate Recovery and other fellowships and programs are independent of Free and Sober. Naming them does not mean they endorse us. Our milestone badges are our own designs.
Our app and content
The app, the 30-day program, the mentor's scripts, our designs, and our name and logo belong to us or to the people who license them to us. We give you a personal, limited, non-transferable right to use the app for your own recovery while these terms are in effect. If you send us ideas or feedback, we may use them without owing you anything.
Changes to Free and Sober and to these terms
We work on the app all the time, so features can change. Whatever changes, the crisis tools, your data, and export and delete stay open to you for as long as your account exists and we offer Free and Sober. At launch, what's in your vault opens only with your key.
When we change these terms, we post the new version here with a new date. If a change is important, we tell you in the app or by email before it takes effect. If you keep using Free and Sober after that, the new terms apply. If you do not agree, you can cancel your subscription and delete your account at any time.
Disclaimers
We work hard to make Free and Sober helpful, safe and reliable, but we cannot promise any result, including that you will stay sober.
To the extent the law allows, Free and Sober is provided "as is" and "as available." We do not promise that it will always work, be free of errors, or be available without interruption. The mentor can be wrong. Hotline numbers, meeting listings and other outside information come from others and can change.
We also do not promise that every recording will play on every phone, operating system or browser; that a Time Capsule, or anything else you store, will never be lost or damaged or fail to open; that Free and Sober will be running on the day a capsule opens, which can be up to ten years away; or that any security measure, including end-to-end encryption, can stop every attack. We never have your key or your recovery key in a form we can use, and we are not responsible for keeping them. iCloud Keychain, Google's backups and other services we don't run work under their own terms, and we are not responsible for what they keep or lose.
Some states do not allow some of these disclaimers, so they may not all apply to you. If you live in New Jersey, the disclaimers in this section and the limits in "Limits on our liability" apply to you only as far as New Jersey law allows them.
Limits on our liability
To the extent the law allows:
- We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, lost profits or lost revenue, arising from your use of Free and Sober.
- We are not liable for the loss of your key or your recovery key; for anything in your vault that can't be opened because they were lost; for a Time Capsule or other content that is lost, damaged or can't be played; or for anything Apple, Google or another company does, or fails to do, with a backup of your phone or your key.
- Our total liability to you for any claim about Free and Sober is limited to the amount you paid for Free and Sober in the 12 months before the claim, or $100, whichever is more.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, or liability that the law does not allow us to limit, such as liability for fraud or for gross negligence, or your rights under the consumer protection laws of the state where you live.
If we have a disagreement
We want to keep this fair and simple.
- Talk to us first. Email support@freeandsober.com and tell us what happened and what you want. Most problems are solved this way. Please give us 30 days to try before you start a legal claim.
- Small claims court. Either of us can bring a claim in small claims court, if it qualifies.
- Other courts. Otherwise, claims go to the Superior Court for the Judicial District of Hartford, Connecticut, or the federal court for the District of Connecticut, unless the law of the state where you live gives you the right to bring the claim at home.
- Governing law. The laws of the State of Connecticut govern these terms, without regard to its conflict of law rules. This does not take away any protection the consumer laws of your own state give you.
App Store and Google Play terms
If you got Free and Sober from Apple's App Store:
- These terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
- If these terms and Apple's Licensed Application End User License Agreement conflict, these terms control, except where Apple's rules require otherwise. Nothing in these terms overrides the Usage Rules in Apple's Media Services Terms and Conditions.
- Your right to use the app is a non-transferable right to use it on Apple-branded devices that you own or control, as the Usage Rules in Apple's Media Services Terms and Conditions allow, except that other accounts linked to your purchase through Family Sharing or volume purchasing may also use it.
- We, not Apple, are responsible for any maintenance and support of the app, as these terms describe or the law requires. Apple has no duty to provide maintenance or support for the app.
- If the app does not match a warranty that applies to it, you can tell Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty duty for the app, and any other claim about a failure to meet a warranty is ours to handle, not Apple's.
- We, not Apple, are responsible for any claims about the app, including product liability claims, claims that it does not meet a legal or regulatory requirement, consumer protection and privacy claims, and claims that it infringes someone's intellectual property. Send questions, complaints and claims to us: Free and Sober Inc., 89 Moody Road, Enfield, CT 06082, (860) 609-1786, support@freeandsober.com.
- You must comply with applicable third-party terms, such as your wireless carrier's, when you use the app.
- You confirm that you are not in a country under a US government embargo or designated by the US government as supporting terrorism, and are not on a US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
If you got Free and Sober from Google Play, Google Play's terms also apply to your purchase.
Everything else
- These terms, together with our Billing and subscriptions page, are the whole agreement between you and us about Free and Sober. Our Privacy Policy and our other policies explain how we handle your information and how Free and Sober works.
- If a court finds part of these terms cannot be enforced, the rest still applies.
- If we do not enforce part of these terms right away, we have not given up the right to enforce it later.
- You may not transfer your rights under these terms to anyone else. We may transfer ours to a company that takes over Free and Sober, under the same promises.
- We send you notices by email to the address on your account or in the app. You can send us a legal notice at support@freeandsober.com, with "Legal notice" in the subject line, or by mail to Free and Sober Inc., 89 Moody Road, Enfield, CT 06082.
